Sean Penn was charged with misdemeanor battery and misdemeanor vandalism after he kicked a photographer and allegedly broke his camera during a scuffle back in October 2009.
The photographer's lawyer told TMZ the lensman needed knee surgery as a result of the incident. The lawyer said he wanted to avoid pressing charges against Penn, but was "stonewalled" by his attorneys.
If Penn is convicted on both counts, he could see jail time of 1 - 1 1/2 years.
